Illinois Maintenance Laws
There are three types of spousal maintenance in Illinois:
- Temporary maintenance: Courts may award either spouse temporary maintenance during a divorce.
- Rehabilitative maintenance: Paid for a period of time deemed necessary to help a spouse obtain job training, education or other tools necessary to become financially stable.
- Permanent maintenance: Often awarded in cases involving long-term marriages in which one spouse has sacrificed his or her career opportunities to be a stay-at-home parent or where there is a significant income disparity between spouses. Courts will consider the length of the marriage, the ability of a spouse to pay maintenance, the need of the other spouse to receive maintenance, the standard of living enjoyed by the parties during the marriage, the age and health of the parties, and other factors impacting the equitable interests and financial welfare of the parties.
